The nursery where a toddler died after choking on a jelly cube has pleaded guilty to two counts of contravening health and safety regulations.

Tiya Chauhan was just 22 months old when she was found unconscious and not breathing on the floor of Dicky Birds Nursery in Dundonald Road, Wimbledon, on August 23, 2012, pictured below.

She died the next day at St George’s Hospital in Tooting.

In late 2015, three years after the youngster's death, Dicky Birds Nursery, which also has branches in Surbiton, Raynes Park and New Malden, was charged with failing to ensure that Tiya was not exposed to the risk of choking on the jelly cube, and with failing to make a suitable and sufficient assessment of health and safety risks.

The jelly had been used as part of a sensory activity, where it was used with spaghetti to create a swamp with prehistoric animal toys for the children to play with.

Tiya’s parents Chetan and Dipa Chauhan, of Graham Road, Wimbledon, were in Kingston Crown Court today, February 11, and looked relieved to hear the guilty pleas.

Nursery owner Rachel Berry was also in court, where the nursery will be sentenced on March 21.

Deciding on a sentencing date, Judge Sarah Plaschkes QC said: “I am mindful of the family in this case, who I’m sure will not want this hanging over them for any longer than is absolutely necessary.”

Previously a jury at a two-month long inquest, held between July and September 2014, found that “inadequate communication between all staff led to a gross failure of supervision of Tiya, which was a significant contributing factor to her death.”

Coroner Fiona Wilcox reported the toddler died of “an accident contributed to by neglect.”

Speaking at the inquest, the nursery said: “At the time we did not appreciate how dangerous jelly play could be.

“Currently we know that food and jelly play remains prevalent in many nurseries and we welcome that the coroner will be making a report regarding the danger of raw jelly in childcare settings.”
